La Sala Plena de la Corporación consideró necesario CONFIRMAR el auto cuestionado y, al igual que la magistrada sustanciadora, concluyó que la Corte Constitucional no es competente para conocer la demanda contra Actos Legislativos que fueron promulgados hace más de un año, aun cuando lo que se pretenda es alegar es la configuración de un vicio de competencia por parte del órgano legislativo.

- Primero. CONFIRMAR en todas sus partes el Auto del treinta y uno (31) de agosto de dos mil veinte (2020), proferido por el despacho de la Magistrada Ponente en el proceso D-13870 mediante el cual se rechazo la demanda presentada por el ciudadano Jorge Luis Pabon Apicella contra el numeral 5deg del articulo 3deg del Acto Legislativo 01 de 2018 "Por medio del cual se modifican los articulos 186, 234 y 235 de la Constitucion Politica y se implementa el derecho a la doble instancia y a impugnar la primera instancia condenatoria"20.
- Segundo. Proceda la Secretaria General de la Corte Constitucional a comunicar el contenido de esta decision al recurrente.
